In a recent opinion, in which the Massachusetts Appeals Court affirmed the trial court's divorce judgment, a very expensive bachelor party in Las Vegas turned into an even more expensive divorce. In a marriage as short as Frank the Tank's  marriage in Old School (and 21 days shorter than Kim Kardashian's second marriage ), a physician ended up paying one year of alimony for a two month marriage. Of the "fault"-based grounds for divorce in Massachusetts, adultery is probably the most complicated. Many individuals seeking a divorce wish to prove to the court that their husband or wife cheated, and therefore was not a good spouse. This certainly affords an opportunity for those seeking to air their soon-to-be ex-spouse's dirty laundry, even requiring the paramour to be named as a co-defendant. However, it requires proving the existence of an extra-marital affair, and finding out all of the details of an affair could be more hurtful than helpful to the faithful spouse. Does Adultery still Matter? 5 Reasons Why it Does.

Besides the obvious issues that adultery presents for a marriage, does it still matter in a divorce? As a divorce attorney and mediator, I often see divorce cases where one party or the other has moved on and begun an affair.
