Is a Friendly Divorce Possible?

This question was recently discussed on a LinkedIn discussion board that I follow, and the consensus was clearly that friendly divorce IS possible. This is also the message of a recent Wall Street Journal article: The Divorce Generation.

That doesn't mean that a friendly divorce is easy or even possible in every case. But more and more people who have reached the unfortunate conclusion that their marriage is over, do not want to have the drawn out and angry divorce that their parents had. To respond to this desire to find a better way, more and more attorneys are offering alternative dispute resolution services, to end your marriage in a better, more civilized way.

    Most people probably think that the term "friendly divorce" is an example of an oxymoron. While many people do find themselves at odds with their exes once the divorce is over, there are a considerable number of couples who are able to remain on friendly terms once the divorce is complete. Just because the marriage is ending, that doesn't mean the process has to bring out the worst in you and your ex.

Updating your Divorce Agreement Template - More Lessons from Cavanagh v. Cavanagh

We recently posted a lengthy review of the the Massachusetts SJC decision in Cavanagh v. Cavanagh (2002)  which included some recommendations for drafting divorce agreements, also typically called Separation Agreements.  The Cavanagh case is best known for it's clarification of how the courts should evaluate support calculations when a case may have both alimony and child support.  However, the case also contained numerous rulings that should make practitioners review their Separation Agreement templates and change some of the ways in which they may have previously drafted certain sections. Massachusetts Family Court Financial Statement - Instructions & Best Practices

During a divorce, or other case in the Massachusetts Probate & Family Court that involves your finances, such as a child support case, you will likely be required to file a court form Financial Statement.  In Massachusetts there are two versions of this form: a "short form" if your income is under $75,000 and a "long form" if your income is $75,000 or more.  Many people find these forms confusing and we've compiled a list of helpful information for filling them out.
